Section 1 — Subject of this Agreement

(1) This Beta Test Agreement (hereinafter "Agreement") governs participation in the beta test program for the software product "MT-AURA Saturation Engine" (hereinafter "Software") by MechinTeq — Mehmet Günes, Adenauerstraße 5, 82178 Puchheim, Germany (hereinafter "Provider").

(2) By registering for the beta program and using the provided beta license key, the participant (hereinafter "Tester") agrees to the terms and conditions of this Agreement.

(3) This Agreement supplements the general End User License Agreement (EULA) of MechinTeq. In the event of a conflict between this Agreement and the EULA, this Agreement shall prevail.

Section 2 — Scope of the Beta License

(1) The Provider grants the Tester a free, non-exclusive, non-transferable license to use the Software solely for testing purposes.

(2) The beta license permits use of the Software on up to two (2) devices simultaneously.

(3) The beta license includes the full functionality of the Software. It is not a feature-limited trial version.

(4) Commercial use of results produced with the Software (e.g., music productions created during the beta phase) is permitted.

Section 3 — Duration and Termination

(1) The beta phase runs for an indefinite period and ends with the official release of MT-AURA. The Provider will notify Testers at least 14 days before the end of the beta phase via email.

(2) After the notification period expires, the beta license key will be deactivated. From that point on, continued use of the Software requires a valid, purchased license.

(3) The Provider reserves the right to terminate the beta phase at any time and without stating reasons.

(4) The Tester may end their participation in the beta program at any time by uninstalling the Software and notifying the Provider via email.

Section 4 — Tester Obligations

Section 5 — Feedback and Intellectual Property

(1) Feedback, improvement suggestions, and bug reports from the Tester may be used freely by the Provider for further development of the Software, without any obligation of compensation.

(2) All rights to the Software (including source code, design, and trademarks) remain exclusively with the Provider.

Section 6 — Warranty and Liability

(1) The Software is provided in its beta stage "as is." The Provider makes no warranty regarding the absence of defects, stability, or fitness for a particular purpose.

(2) The Tester uses the Software at their own risk. The Provider shall not be liable for damages arising from the use of the beta Software, including but not limited to data loss, project corruption, or system instability.

(3) The limitation of liability does not apply to damages caused by intentional misconduct or gross negligence of the Provider, or to injury to life, body, or health.

(4) The Tester is solely responsible for the proper configuration of their audio output (volume levels, monitoring).

Section 7 — Data Privacy

(1) As part of the beta program, the following data will be collected and stored: name, email address, DAW used, and experience level.

(2) This data is used exclusively for managing the beta program, communicating with the Tester, and evaluating feedback.

(3) Upon activation of the Software, a pseudonymized hardware ID (machine ID) and the license key are additionally transmitted to the license server.

(4) The privacy policy of MechinTeq (available at mechinteq.de/datenschutz) applies. The Tester has the right to access, correct, and delete their data at any time.

Section 8 — Special Conditions for Beta Testers

(1) As a thank-you for participating in the beta program, each Tester will receive a personal discount code for the full version of MT-AURA upon conclusion of the beta phase.

(2) The type and amount of the discount will be determined by the Provider at their sole discretion and communicated in a timely manner via email.

(3) There is no legal entitlement to the discount.

Section 9 — Final Provisions

(1) This Agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Should any provision of this Agreement be or become invalid, the validity of the remaining provisions shall remain unaffected.

(3) Amendments and additions to this Agreement must be made in writing.
